Welcome to Cobi. Cobi Computer Science ("Cobi") is an online educational platform operated by Popfizz Corp. ("Popfizz," "we," "us," or "our").
These Terms of Service ("Terms") govern your access to and use of Cobi, including our website, courses, software, and related services (collectively, the "Service").
By accessing or using the Service, you agree to these Terms. If you are using Cobi on behalf of a school or other organization, you represent that you have authority to accept these Terms on its behalf.
Cobi provides online computer science and related educational resources primarily for middle and high school students, teachers, and schools.
Students may create Cobi accounts, but access to courses may require an invitation or authorization from a teacher or school.
Schools and teachers are responsible for determining whether Cobi is appropriate for their students and for using Cobi in accordance with applicable laws, school policies, and agreements with Cobi.
You are responsible for maintaining the security of your account credentials and for activities conducted through your account.
You may not share your account credentials with another person or use another person's account without authorization.
Cobi may suspend or terminate accounts that violate these Terms or that present a security, legal, or operational risk.
Certain Cobi services require payment or a subscription.
Prices, subscription terms, license terms, and other applicable commercial conditions may be provided in a quotation, order, invoice, or other agreement between Cobi and the customer.
If there is a conflict between these Terms and a written agreement or order between Cobi and a school or organization, the written agreement or order will control.
Unless otherwise stated in a written agreement, purchases may be canceled within 30 days of the start of service for a full refund. Requests for cancellation or refunds should be sent to hello@gocobi.com.
After the applicable refund period, payments are generally non-refundable unless otherwise agreed in writing or required by applicable law.
Teachers and schools are responsible for managing student access to Cobi and for providing Cobi with information necessary to create or manage student accounts.
Schools are responsible for ensuring that their use of Cobi complies with applicable laws and school policies, including any requirements relating to student privacy and parental rights.
Cobi may rely on authorization provided by a school or educational institution to provide educational services to its students, as permitted by applicable law.
Students and teachers retain their rights in content they create and submit through Cobi, including code, assignments, and other submissions ("User Content").
You grant Cobi a limited, non-exclusive right to use, store, reproduce, and process User Content only as reasonably necessary to provide, maintain, secure, and improve the Service and to provide the educational services requested by the school or teacher.
Cobi does not claim ownership of student-created work.
Cobi may provide optional AI-powered features, including AI-assisted grading.
AI-generated grades or feedback are intended to assist teachers and do not replace teacher judgment. Teachers may review and override AI-generated grades.
AI features may depend on third-party AI providers and are subject to the limitations and terms described in Cobi's Privacy Policy.

The Service and its content, including courses, lessons, text, graphics, software, designs, logos, and other materials provided by Cobi, are owned by or licensed to Popfizz Corp. and are protected by applicable intellectual property laws.
Subject to these Terms and any applicable subscription or license agreement, Cobi grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended educational purpose.
You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from Cobi's proprietary content without our prior written permission.
Cobi may integrate with or rely on third-party services, including Google, Canvas, Schoology, LTI-compatible systems, Stripe, Amazon Web Services, and Anthropic.
Third-party services may be subject to their own terms and privacy policies. Cobi is not responsible for services that are operated independently by third parties.
Your use of Cobi is also subject to our Privacy Policy, which explains how Cobi collects, uses, shares, and protects personal information.

You may stop using Cobi at any time.
Cobi may suspend or terminate access to the Service if we reasonably believe that:
For paid school or organizational accounts, termination and cancellation rights may also be governed by the applicable written agreement or order.
Upon termination, your right to access the Service may end. Certain provisions of these Terms, including those concerning intellectual property, disclaimers, limitations of liability, and indemnification, will continue to apply after termination.
We make reasonable efforts to keep Cobi available and functioning properly, but we do not guarantee that the Service will always be uninterrupted, error-free, or available at all times.
Cobi may occasionally be unavailable because of maintenance, updates, technical problems, security issues, or circumstances beyond our reasonable control.
To the maximum extent permitted by law, Cobi is provided on an "as is" and "as available" basis.
We do not guarantee that the Service will meet every user's requirements or that educational outcomes, grades, or learning results will be achieved through use of the Service.
We disclaim warranties that cannot be excluded under applicable law.
To the maximum extent permitted by law, Popfizz Corp. and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Cobi.
To the maximum extent permitted by law, our total liability arising from or related to the Service will not exceed the amount paid to Cobi for the Service during the twelve months preceding the event giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Popfizz Corp. and its officers, employees, and affiliates from claims, damages, liabilities, costs, and expenses arising from your violation of these Terms, your misuse of the Service, or your violation of applicable law or another person's rights.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.
Any dispute arising from these Terms or your use of Cobi will be subject to the applicable state or federal courts located in California, unless applicable law requires otherwise.
We may update these Terms from time to time.
When we make changes, we will update the "Last Updated" date at the top of these Terms. If a change is material, we may provide additional notice where appropriate.
Your continued use of Cobi after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
